Khái niệm: Đăng ký môi trường là việc chủ dự án đầu tư, cơ sở sản xuất, kinh doanh, dịch vụ thực hiện đăng ký với cơ quan quản lý nhà nước các nội dung liên quan đến xả chất thải và biện pháp bảo vệ môi trường của dự án đầu tư, cơ sở sản xuất, kinh doanh, dịch vụ.

Đối tượng: Dự án đầu tư và sở sản xuất, kinh doanh, dịch vụ hoạt động trước ngày Luật này có hiệu lực thi hành có phát sinh chất thải không thuộc đối tượng phải có giấy phép môi trường;

Căn cứ thực hiện:

• Luật Bảo vệ môi trường 72/2020/QH14 thông qua ngày 17/11/2020
• Nghị định số 08/2022/NĐ-CP ngày 10 tháng 01 năm 2022 của Chính phủ quy định chi tiết một số điều của Luật Bảo vệ môi trường
• Thông tư số 02/2022/TT-BTNMT ngày 10 tháng 01 năm 2022 của Bộ trưởng Bộ Tài nguyên và Môi trường quy định chi tiết thi hành một số điều của Luật Bảo vệ môi trường

Thời điểm thực hiện:

• Dự án đầu tư (thuộc đối tượng phải thực hiện DTM): trước khi vận hành chính thức;
• Dự án đầu tư (không thuộc đối tượng phải thực hiện DTM): trước khi cơ quan có thẩm quyền cấp giấy phép xây dựng hoặc trước khi xả chất thải ra môi trường
• Cơ sở đã đi vào hoạt động: trong thời hạn 24 tháng kể từ ngày Luật BVMT có hiệu lực thi hành.

Lập lại Đăng ký môi trường: khi có thay đổi về nội dung đã đăng ký, chủ dự án đầu tư, cơ sở có trách nhiệm đăng ký môi trường lại trước khi thực hiện các thay đổi đó.

Definition: Environmental registation means that the owner of an investment, projects, and production, business or service establishment registers with the state management agency the content related to waste discharged and protection measures of measures of investment projects, production, business and service establishments.

Objects: Investment projects and production, business, and service departments operating before the effective date of this Law that generate wastes that are not subject to environmental permits;

Implementation basis:

• Law on Environmental Protection 72/2020/QH14 passed on November 17,2020
• Decree No.08/2022/ND-CP dated January 10,2022 of the Governmnent detailing a number of articals of the Law on Environmental Protection.
• Cirlcular No.02/2022/TT-BTNMT dated January Resources and Environment detailing the implementation of a number of articles of the Law on Environmental Protection

Implementation time:

• Investment projects (subject to DTM  implementation): before offcial operation;
• investment projects (not subject to DTM implementation): before competent authorities grant contruction permits or before discharge of waste into the environment
• The establishment has been put into operation: within 24 months from the effective date of the Law on Environmental Protection.

Re-registation of environmental registation: when there is a change in registered content, the investor of the investment project or establishment is responsible for re-registering the environment before making such changes
